HOW ALL CASE STUDIES AND ARTICLES ARE PRODUCED

Please note that the case studies and articles I share on topics relating to civil, structural, mechanical and electrical engineering, construction, economics, manufacturing, artificial intelligence, semiconductors, ESG, standards, codes of practice, and other related disciplines are not produced in isolation.

QHSEL Consultancy Sdn. Bhd. is supported by an advisory panel and an extensive network of trusted friends, industry practitioners, professional associations/bodies and subject matter experts who willingly contribute their knowledge, insights, and professional experiences.

This collective includes Professional Engineers with Practising Certificates (PEPC), licensed brokers, economists, academicians, competent persons, auditors, risk assessors, contractors, consultants, clients, enforcement officers, active and former intelligence operatives, IT and cybersecurity specialists, AI practitioners, VR/AR/MR professionals, architects, bankers, Syariah experts, and specialists from various other fields.

As such, this is far from a one-man effort. Behind every article is a panel of experienced professionals who provide guidance, technical input, peer review, and practical perspectives drawn from real-world experience.

Many of these contributors prefer to remain anonymous to protect the confidentiality of projects, organisations, and sensitive information entrusted to them. Their motivation is not recognition, but rather to contribute towards a greater purpose: promoting sound practices, strengthening governance, enhancing compliance, improving industry standards, and reducing deficiencies, non-conformances, and avoidable failures across various sectors.

The views presented are therefore often the result of multidisciplinary collaboration, professional discourse, and collective expertise rather than the opinion of a single individual.

Safety Review: Fatal Ready-Mix Concrete Truck Accident

Disclaimer: This review is intended for safety awareness and learning purposes. It is based on limited available information and does not constitute an official investigation or determination of liability. Possible causes discussed, including slippery ground, are hypotheses requiring verification. No conclusion is drawn regarding negligence or responsibility by any individual or organisation. Final findings remain subject to investigation by the relevant authorities

1. Nature of the accident

A worker died after the ready-mix concrete truck he was operating overturned and fell into a basement construction area during concrete supply operations. The incident involved a vehicle rollover and fall, exposing the operator to fatal crushing and entrapment.

2. Possible Causes Requiring Investigation

Evidence should include CCTV, witness accounts, surface conditions, weather records, vehicle inspection findings, delivery records and engineering calculations.

Evidence should include CCTV, witness accounts, weather and surface conditions, vehicle inspection findings, engineering calculations, traffic plans, and driver–signalman instructions.

3. Applicable Requirements and Guidance

  • Occupational Safety and Health Act 1994, as amended: Section 15 addresses safe plant, systems of work, access, training and supervision. Section 18B requires risk assessment and necessary risk controls,
  • Occupational Safety and Health (Construction Work) (Design and Management) Regulations 2024: relevant to construction planning, coordination and management of site safety, and
  • DOSH Excavation and Vehicle Safety Guidance: relevant to ground stability, loads near excavation edges, suitable access routes and safe vehicle movements.

4. Potential Root Causes

The investigation should determine whether deficiencies existed in:

- Risk assessment: HIRARC and the safe work method statement did not adequately address loaded-truck movements, slippery surfaces, restricted visibility or excavation-edge hazards,

- Engineering controls: Access routes, temporary structures or vehicle restraints were unsuitable for the actual loads and movements,

- Inspection and maintenance: Drainage, housekeeping, vehicle checks or inspections after rain were ineffective,

- Coordination and supervision: Responsibilities between site management, the concrete supplier, driver and signalman were unclear, and

- Stop-work arrangements: Unsafe ground conditions, loss of communication or uncontrolled movements did not trigger an immediate stop.

These are potential management failures, not established findings. The absence of a signalman or slippery ground should not automatically be treated as the sole cause.

5. Risks and Recommended Corrective Actions

6. What To Do and Whose Responsibility

The following combines emergency response, statutory reporting, investigation and preventive measures. Responsibilities must be confirmed against actual employment arrangements, appointments and applicable legal duties.

The reporting requirements arise under Section 32 of OSHA 1994 and NADOPOD Regulations 2004. Fatal accidents require immediate notification, a JKKP 6 report within seven days, and recording in JKKP 8. Delegating paperwork to an SHO does not transfer the employer’s statutory responsibility.

For this retrospective review, verify records before concluding whether these actions were taken. A signalman supports safe movement but cannot replace stable ground, suitable access or engineered vehicle protection.
