LANDSLIDE ISSUE - PLEASE MAKE SOME SENSE - A CALL FROM NIK ZAFRI

A landslide caused by heavy rains hit an orphanage in Malaysia on Saturday, killing two children and burying at least 21 others (Rumah Anak Yatim Hidayah Madrasah At Taqwa)

I laud both Federal Government and State Government for taking prompt actions such as providing temporary shelters for the needy, sending officers from fire department and the police. Not forgetting donations start pouring as I speak.

As a Muslim, I like to dedidate "Al-Fatihah" to them.

After so many years, once again, the "blaming + fire-fighting" culture come into the picture.

A tabloid reported that the orphanage building has never been given an approval.**

This is not the issue. The real issue is :

How come the building has been there for quite some time and only now records show that there has never been an approval?**

How about continual monitoring and make professional recommendations BEFORE it happened?

And nobody is caring or professional enough to protect the slope? (aaa, a tender is required for that..cool...make money otherwise no protection)

After the incident happen, everyone try to become "Geotechnical Engineers" talking about soil and slope paramenters - the funny thing is that 'the so-called technical guys' are only considering soil conditions, no saying about slope gradient, applied load, hydraulic impact, shear and other factors. Leave it to JKR please.

So if these factors are taken into account, how much will it cost? How long will it take? Will the building be declared safe and they can return to the building? (most likely not)

A question; on the first place; the contractor paid from his own pocket to build the orphanage house? No site investigation? No soil test?

I wonder who approve this structure right under the nose of the authorities?**

Again - we wait for something to happen first, then we act.

Although one relevant Ministry instructed to provide immediate assistance to the orphans and family of the victims but there has been a statement being made before that that the Orphanage is not registered with welfare department.

Please...so nobody took action before this incident happen to alert them that we can't provide assistance if you're not registered?

Rumah Anak-anak Yatim dan Anak-anak Hidayah Madrasah Al-Taqwa is not a political issue, this is about young orphans requiring a home and someone is good enough to shelter it for them.

Unless it is a political issue; which I do not know of; then that's a different story. Some people may not want to give even a sen of donation because they are not supporting a certain political party. (I have been giving them donations quietly as well...not to show off but it's because it's based on humanitarian grounds not about political or religious sects)

Then, where do we go? Blame it on heavy downpour!

As 'the then' VVIP said : "God's Act". Fine..blame it on the Creator then..Some people make no sense.

The facts :

For those who are used to the area, just check what's going on on the top of the nearby hill and adjacent areas.

Landslides may be triggered by rains, floods, earthquakes, and other natural causes but it can also be caused by "human-made causes" - such as grading, terrain cutting and filling, excessive development, etc.

Trust me, I don't have to become an engineer to know all these things, it can happen in developed areas, undeveloped areas, or any area where the terrain was altered for roads, houses, utilities, buildings, and even for lawns in one's backyard.

Take also into account some illegal quarrying and illegal logging activities as well..I'm not blaming/pinpointing anyone but as they say "just in case"

Someone sms me to look into another statement that The orphanage was built about 15 years ago and at that time or now, it was NOT COMPULSORY for them to meet requirements set by JKR. It means that 2011-15 = 1996

What happen then?

GUIDELINES on technical and safety aspects of highrise building construction in hill slopes in Selangor will be issued to developers in two days.

The guidelines, formulated by a high-level committee formed by the Selangor Government to check construction of high-rises in hilly areas has defined a building above five-storey as a high-rise building.

(I'm not talking about highrise, I'm talking about "hilly areas" and "slope protection")

Yes, people tell me that this is the PREVIOUS Selangor Government. Wow...so the current one has NO jurisdiction.

So why can't there be a uniformity on guidelines like this?

Another person came and said : "It is out of our operational zone and should come under the Rural and Regional Development Ministry"

Ok fine..so what's next?

Let's be proactive from now on and not reactive. Let's stop the blaming culture from now on. Enough is enough.

CHINA COMING DOWN? NO WAY!! - NIK ZAFRI



This is up to 2005...look at the figures..you all can calculate - can you not?


Once again, some speculators are trying to 'underestimate' China. Last time it was Dubai - now it goes further. The 'bubbly' thing again...there will be bubble in China? What would they think of next? Relive the decoupling theory?

Some people didn't read figures or not bothered with figures and I find this less surprising as these so-called forecasters are not from China. I do not know if the speculators have actually been in China to see for themselves what's happening - US bluechips are coming into China even GM besides than Hewlett Packard & Intel.

Memory serves - In 2009 - China's GDP almost 14% - and this surprised every major banks of the world!! - this year 2010 - it's gonna get BIGGER. The figures originally forecasted by "smart Alexes" were a lot lower and now - they are wrong and still wrong!

One thing I can tell you all that most developing East Asia countries like to stay 'below radar detection' - not to distract too much publicity. China is definitely one of them. They are actually much bigger (as big as Russia) than the formal economists estimation or calculations.

It would not be proper for me to say that China will stay strong in its growth; as well as to other EA countries as well. There may still be minor subprime mortgage crisis elements (I'm saying 'maybe') but China will emerge.

One thing I learn from China's economic aspirations is that the conventional economics 'supply and demand' + 'equilibrium' or 'elasticity' point of view still work on them - where there should be less government intervention (not that we do not need them at all) but to let the market correct by itself. I also share the following views :

a) that (accurate) data collection, analysis and action plan based on these datum are so important,

b) organizations must adopt true corporate governance principles - that is....transparency,

c) bribery must be reduced or better - eliminated!,

d) all taxes must be paid,

e) Work attitude need to be changed - not the system - the system is fine. Don't come out with good figures or window dressings to impress the top management or to get stimulus packages but come out with the REAL figures based on data collection & analysis.

f) Wireless technology/e-commerce/B2B/B2C and all the likes are assets not foes.

g) White Collar Crimes need to be reduced - not on the dumb ones/scapegoats/pawns but on the 'smart ones' abusing their skills

Good observations. One tiny thing…the PFI definition is not mine..it’s wikipedia’s (of course I reserve my comments..for now) Pros and cons…what doesn’t? If I read the statement you’ve inserted here carefully, there’s something along the line saying about ‘process wastes.’ Now if I’m not far too mistaken, in the thread – construction quality management, I did talk about ‘cost of quality’. And if I read it right again, the statement sounds like it’s taken from some audit report (intergrated financial and process audit – the accenture way)…yeah…they cover ‘cost of quality’ too – defects, system NCRs, logistics, and so on (even has years of projections on 'waste' alone) Well buddy, not only PFI, ‘waste’ issue is happening everywhere – even in Turnkey/Design & Build /EPCC /conventional…But again, this does not mean in any way that I’m with or not with PFI. Let's wait and see first. It's not really fair to pass a judgement in such a short time.

BOT is the mechanism of PFI and they are not independent but rather complementary in a sense that PFI uses BOT method to move. Here's another good link:*

In the BOO scheme, the difference from BOT is that the ownership of the project remains in the private sector.

-Grant of concession
-Tax incentives
-Appropriate land and space
-Subsidies or any assistance if necessary

The role of the private sector is to do the following:

- High quality and cost effective public service
- Low cost finance arrangements
- Technology and skill transfer
- Contractual schedule control
- Management of four risks, namely
--Facility completion risk
--Operating risk
--Proceeds collecting risk, and
--Investor’s risk

Types of PFI Projects

Basically, there are three types of projects that the government encourages within the PFI; services sold to the public sector, financially free-standing projects and joint ventures (Treasury Taskforce, 1997a: para. 1.05-1.06; Akintoye et. al, 1998; and Allen, 2003). At present, the major focus of PFI activity has been on the first of these, i.e. services sold to the public sector (Treasury Taskforce, 1997a: para. 1.05)

a. Services sold to the public sector

The provision of public services using assets that are financed, designed, built and operated by a private sector consortium and are paid for by a public body through service charges (Armstrong, 1996 and The Scottish Parliament, 1999). These are normally referred to as Design, Build, Finance and Operate (DBFO) schemes. Under the scheme, the public sector purchaser needs to be assured that services provided will give greater value for money (VFM) than the conventional procurement. Examples of the DBFO projects are:

· the provision of prison places by the private sector through designing, building, financing and operating new prisons

· hospitals where the private sector will meet the costs of the building and take on the responsibility for the provision and management of ancillary services such as cleaning, catering and maintenance (Illidge and Cicmil, 2000)

In other words, at the heart of the DBFO approach the focus is changed away from the procurement of assets to the purchase of services associated with those assets (Dick and Akintoye, 1996).

b. Financially free-standing project

This is where the project is entirely financed and managed by the private sector. The revenues for the services supplied are mainly from payment by the end users. This type of project does not require a VFM test but does require government approval (Owen and Merna, 1997). In other words, public sector involvement is limited to enabling the project to go ahead through assistance with planning, licensing and other statutory procedures. The Second Severn Bridge and the Dartford River Crossing are the examples of projects under this category (Treasury Taskforce, 1997a: para. 1.06).

c. Joint ventures

For this type of project, the public and private sector work as a partnership but the private sector retains control. The public sector investment could be in the form of grant, guarantee or subordinated debt. In return, the public sector will receive a proportional share of any profit (Illidge and Cicmil, 2000). This type of project requires a VFM test and needs to conform to these criteria:

· Private sector partners in a joint venture should be chosen through competition
· Joint venture control held by private sector
· A clear definition of the government’s contribution and its limitations
· Clear agreement of risk and reward allocation, defined and agreed in advance, ensuring that the private sector is genuinely assuming some of the risk.

The Channel Tunnel rail link, Croydon Tramlink, Manchester’s Metrolink and urban regeneration schemes are examples of joint venture projects.
