PENDATANG ASING TANPA IZIN - UNDOCUMENTED IMMIGRANTS

Saya pernah melalui kehidupan di bawah tiga kerajaan yang berbeza. Daripada apa yang saya lihat, isu pendatang asing ini bukanlah masalah baharu dan sudah lama berlaku di bawah mana-mana kerajaan sekalipun. Malah, setiap kali berlaku pertukaran kerajaan, masalah ini seolah-olah menjadi semakin kompleks dan sukar ditangani.

Namun begitu, kita perlu membezakan antara pelarian, pendatang asing tanpa izin (PATI) dan pendatang asing yang mempunyai permit yang sah. Mereka yang mempunyai permit sah berada di Malaysia atas tujuan tertentu, khususnya untuk bekerja, dan tertakluk kepada undang-undang serta syarat yang ditetapkan. 

Apa yang lebih membimbangkan ialah mereka yang enggan atau tidak kembali ke negara asal selepas tempoh yang dibenarkan, termasuk mereka yang mungkin terus tinggal secara tidak sah atau berasimilasi dalam masyarakat tanpa dapat dikesan dengan mudah.

Dan isu ini bukan hanya melibatkan satu kelompok tertentu (Ini bukan sahaja melibatkan kelompok "R, B, I, M, P" sahaja tetapi juga melibatkan kelompok yang jarang kita berikan perhatian). Mereka yang datang dari China ada, begitu juga dari negara-negara Eropah dan pelbagai negara lain. Apabila mereka berada di kawasan seperti KLCC atau Bukit Bintang, bercampur dan berasimilasi dengan pelancong serta masyarakat tempatan, kita mungkin sukar mengenal pasti siapa yang benar-benar pelancong, siapa pekerja asing, siapa yang tinggal secara sah dan siapa pula yang mungkin telah tinggal melebihi tempoh yang dibenarkan.

Justeru, saya melihat pendekatan kita tidak boleh hanya bergantung kepada pemeriksaan fizikal dan operasi penguatkuasaan secara konvensional. Sistem risikan dan pemantauan kita perlu jauh lebih canggih, bersepadu dan berasaskan data, dengan tetap menghormati undang-undang, privasi serta hak individu.

Ini bukan semata-mata soal menghalang orang asing datang ke Malaysia. Ini soal memastikan siapa yang masuk, atas tujuan apa, berapa lama mereka berada di sini dan sama ada mereka mematuhi undang-undang negara, dapat dikenal pasti dengan lebih berkesan.

Masalah ini sudah terlalu lama berlarutan. Apa yang diperlukan bukan sekadar tindakan bermusim apabila isu menjadi tular, tetapi satu pendekatan strategik, konsisten dan berterusan merentasi mana-mana kerajaan.

Pada pandangan saya, satu lagi perkara yang tidak boleh dipisahkan daripada isu ini ialah rasuah. Jika ada kelemahan dalam kawalan sempadan, penguatkuasaan, permit kerja, dokumentasi atau pemantauan, kita juga perlu berani melihat kemungkinan wujudnya ruang untuk rasuah dan penyalahgunaan kuasa.

Selagi rasuah tidak dibendung dengan tegas, sebaik mana sekalipun sistem yang kita bina, masih akan ada pihak yang mencari jalan untuk memintasnya.

Sebab itu, usaha menangani isu pendatang asing bukan sekadar mengenai operasi penguatkuasaan atau penghantaran pulang. Ia juga mesti melibatkan pengukuhan integriti, pencegahan rasuah, pemantauan pegawai yang mempunyai kuasa, audit terhadap proses pengeluaran permit serta penggunaan sistem risikan dan data yang lebih bersepadu.

Masalah ini sudah terlalu lama berlaku. Jika kita benar-benar mahu menyelesaikannya, kita perlu menangani bukan sahaja mereka yang melanggar undang-undang, tetapi juga mana-mana pihak yang membuka ruang, memudahkan atau melindungi pelanggaran tersebut demi kepentingan tertentu.

Tanpa membendung rasuah, kita mungkin hanya menangani simptom, sedangkan punca yang membolehkan masalah itu terus berulang masih kekal.

I have lived under three different governments. From what I have seen, the issue of foreign migrants is not a new problem; it has existed for a long time under governments of all political administrations. In fact, whenever there is a change of government, the problem seems to become increasingly complex and more difficult to address.

Nevertheless, we need to distinguish between refugees, undocumented foreign migrants (PATI), and foreign migrants who hold valid permits. Those with valid permits are in Malaysia for specific purposes, particularly for employment, and are subject to the laws and conditions that have been established.

What is more concerning are those who refuse or fail to return to their countries of origin after the permitted period has expired, including those who may continue to remain in the country illegally or become assimilated into society without being easily detected.

And this issue does not involve only one particular group. It does not involve only the "R, B, I, M, P" group, but also groups that we rarely pay attention to. There are those who come from China, as well as from European countries and various other parts of the world. When they are in areas such as KLCC or Bukit Bintang, mixing and blending in with tourists and the local population, it may be difficult for us to identify who is genuinely a tourist, who is a foreign worker, who is residing legally, and who may have overstayed the permitted period.

Therefore, I believe our approach cannot rely solely on physical inspections and conventional enforcement operations. Our intelligence and monitoring systems need to be far more sophisticated, integrated and data-driven, while continuing to respect the law, privacy and individual rights.

This is not merely about preventing foreigners from coming to Malaysia. It is about ensuring that we can more effectively identify who enters the country, for what purpose, how long they are staying, and whether they are complying with the laws of the country.

This problem has persisted for far too long. What is needed is not merely periodic action whenever the issue goes viral, but a strategic, consistent and continuous approach that transcends changes in government.

In my view, another matter that cannot be separated from this issue is corruption. Where there are weaknesses in border controls, enforcement, work permits, documentation or monitoring, we must also be willing to examine the possibility that such weaknesses create opportunities for corruption and abuse of power.

As long as corruption is not firmly addressed, no matter how good the system we build may be, there will still be parties looking for ways to circumvent it.

That is why efforts to address the foreign migrant issue cannot be limited to enforcement operations or repatriation. They must also include strengthening integrity, preventing corruption, monitoring officials who hold authority, auditing the process of issuing permits, and employing more integrated intelligence and data systems.

This problem has existed for far too long. If we genuinely want to resolve it, we need to address not only those who violate the law, but also any parties who create opportunities for, facilitate, or protect such violations for certain interests.

Without curbing corruption, we may only be treating the symptoms, while the underlying causes that allow the problem to keep recurring remain in place.
